These Terms of Service ("Terms") govern your use of the 12TONE website and services (the "Service") operated by [COMPANY NAME], [COMPANY ADDRESS] ("we," "us"). By purchasing an analysis or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

12TONE provides automated personal color analysis based on the Korean 12-season color methodology. You submit photographs; our systems generate a color analysis, palette recommendations, and, if subscribed, monthly seasonal palette updates informed by weather data for the location you provide.

The Service is provided for informational and entertainment purposes. Results are generated by an automated analysis system and reflect an automated assessment of the materials you submit. They are style and cosmetic guidance only — not medical, dermatological, or professional advice, and we do not guarantee any particular personal, social, or professional outcome from following them.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase the Service. By using the Service you represent that you meet this requirement and that all photos you submit are of yourself, or of a person from whom you have obtained consent to submit them (for example, a gift recipient submitting their own photos).

3. Purchases, Subscriptions & Billing

  • One-time analysis. The color analysis is a one-time purchase at the price shown at checkout.
  • Seasonal Drops subscription. If you enroll in Seasonal Drops, your first month is included with your analysis. Thereafter, your payment method is charged the subscription price shown at checkout on a recurring monthly basis until you cancel.
  • Clear disclosure. The renewal price, billing frequency, and cancellation method are displayed before you subscribe and in every billing receipt.
  • Cancellation. You can cancel at any time via the cancellation page or the cancellation link included in every billing email. Cancellation is effective at the end of your current billing period; you retain access through the period already paid, and content already published to your palette page remains accessible.
  • Price changes. We may change subscription pricing with at least 30 days' notice by email; changes apply to renewals after the notice period.
  • Taxes. Prices may be subject to applicable taxes depending on your location.

4. Refunds

The one-time analysis is covered by a 30-day money-back guarantee: if you are unsatisfied, contact us within 30 days of purchase via the contact page and we will refund the analysis price. Subscription charges for months already delivered are non-refundable, except where required by law. Refunds are issued to the original payment method.

5. Your Content & Photos

You retain all rights to the photos you submit. You grant us a limited license to process your photos solely to deliver the Service. Photos are processed by automated systems. Depending on your package, photos may be securely retained to enable future analyses without re-uploading, and are permanently deleted upon your request, as described in our Privacy Policy. We do not use your photos to train or improve any models or systems.

6. Your Palette Page

Your results are delivered on a personal page accessible via a unique private link. Anyone with the link can view the page, so treat the link as confidential and share it only with people you choose. You may request deletion of your palette page at any time via the contact page.

7. Acceptable Use

  • Do not submit photos of another person without their consent, or photos of minors.
  • Do not attempt to reverse-engineer, scrape, resell, or systematically extract the Service or its outputs.
  • Do not use the Service in violation of any applicable law.

We may suspend or terminate access for violations of these Terms, with a refund of any unused subscription period where required by law.

8. Intellectual Property

The Service — including its design, text, methodology implementation, and software — is owned by us or our licensors. Your analysis results are licensed to you for personal, non-commercial use. You are welcome to share your own palette socially; you may not resell analyses or offer them as a service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AUTOMATED RESULTS MAY VARY BASED ON PHOTO QUALITY, LIGHTING, AND OTHER FACTORS, AND WE DO NOT WARRANT THAT ANY RESULT WILL BE ACCURATE, COMPLETE, OR SUITED TO YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, AND WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Changes to the Service or Terms

We may modify the Service or these Terms. Material changes will be posted on this page with an updated date, and for subscribers, notified by email. Continued use after changes take effect constitutes acceptance.
